When children are involved, highly contested divorce proceedings have an additional layer of complication, particularly when it is unclear who will ultimately be named the custodial parent, or when there are allegations of child abuse and maltreatment.
In Connecticut, the health, safety, and wellness of minor children is the primary concern of the family court. While it is generally not the case that a child will hire an attorney, a Judge may appoint a Guardian Ad Litem (GAL) to investigate the family circumstances on behalf of the Court, or if the child is older may require parents to retain an Attorney for the Minor Child(ren) (AMC). The child’s attorney acts according to the express wishes of the child (which means the child must be of a mature and appropriate age and cognitive ability to have an attorney appointed for them by the Court versus a GAL), while the more commonly assigned GAL is a trained child advocate who serves the needs of the child and their best interests.
When issues regarding custody and visitation arise, necessitating the appointment of a GAL or AMC, the Court prefers the parents review from the list of qualified professionals and reach agreement on who to select as GAL or AMC. If the parents are unable to reach agreement, the Court will appoint whomever the Court deems appropriate.
